Dubai and UAE move to align crypto frameworks under new partnership

The Virtual Assets Regulatory Authority (VARA) of Dubai has clarified its stance on mutual license recognition within the United Arab Emirates (UAE). While VARA’s regulatory framework incorporates the concept of mutual license recognition between different emirates, it’s crucial to understand that this doesn’t equate to automatic passporting or seamless cross-border operation for virtual asset service providers (VASPs).

The statement issued to Cointelegraph underscores a critical distinction: license recognition facilitates a more streamlined process, but it does not grant automatic authorization to operate in other emirates solely based on a license obtained in one. Each emirate retains its regulatory autonomy and maintains its own specific licensing requirements. Therefore, a VASP licensed in one emirate seeking to operate in another must still adhere to the specific regulations and undergo the appropriate application process within the target emirate.

This clarification emphasizes the nuanced approach to regulation within the UAE’s rapidly evolving virtual asset landscape. The UAE, aiming for a unified and efficient regulatory environment, recognizes the need for inter-emirate cooperation and harmonization. Mutual license recognition serves as a tool to reduce bureaucratic hurdles and potential duplications, fostering a more efficient and less fragmented regulatory approach. However, this cooperative mechanism does not supersede the individual regulatory authority of each emirate.

Consequently, VASPs should not interpret mutual license recognition as a shortcut or automatic approval to operate across the entire UAE. The process remains rigorous, requiring compliance with individual emirate regulations and a separate application procedure for each jurisdiction where the VASP intends to conduct business. This approach guarantees that all VASPs operating within the UAE maintain compliance with the relevant legal and regulatory framework, safeguarding consumer protection and maintaining market integrity across the federation. The careful balance between inter-emirate collaboration and individual regulatory oversight ensures a robust and sustainable regulatory environment for the continued growth and development of the UAE’s virtual asset sector. VASPs must proactively engage with the relevant authorities in each emirate to ensure complete regulatory compliance.
