What are the next steps for the US stablecoin bill?

The GENIUS Act, a bill aiming to regulate stablecoins in the US, faces an uncertain future. After failing to pass the Senate on May 8th due to concerns over President Trump’s financial ties to the cryptocurrency industry, a motion to reconsider was made, paving the way for a potential revote in the coming days. This delay, however, hasn’t dampened the enthusiasm of some, with the Cedar Innovation Foundation urging swift passage.

The bill’s failure stemmed from bipartisan concerns. Democratic lawmakers demanded a halt to all digital asset legislation until Republican concerns about Trump’s potential conflicts of interest were addressed. Republicans, however, reportedly remain unwilling to amend the bill to restrict Trump’s or his administration’s involvement in digital assets, citing constitutional limitations.

Despite the stalemate, some believe the delay may be beneficial. Liat Shetret of Elliptic suggests that the pause provides an opportunity to clarify provisions and address lawmaker concerns. However, the path forward remains unclear. Should Republicans reintroduce the bill unchanged, securing the necessary 60-vote majority to overcome a Democratic filibuster remains questionable.

The core of the issue lies in Trump’s extensive cryptocurrency holdings and his family’s involvement with World Liberty Financial and its USD1 stablecoin. This has raised serious concerns regarding potential corruption and insider trading. Democratic Representative Maxine Waters, highlighting the lack of conflict-of-interest provisions in the Republican bill, voiced strong opposition.

Meanwhile, Democrats have introduced countermeasures, proposing legislation to bar members of Congress, the President, Vice President, and their families from profiting from memecoins. Further, Senators Warren and Van Hollen urged Trump to divest from USD1 before engaging in any foreign deals. Reports indicate Trump’s crypto holdings account for a significant portion of his wealth, adding to the gravity of the situation. The involvement of Trump’s sons as “Web3 ambassadors” further complicates the matter. The coming days will determine whether the GENIUS Act can navigate these political and ethical challenges.
